By accessing or using ClaryBook ("the Service"), operated by ClaryBook ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance.
2. Description of Service
ClaryBook is a bookkeeping tool that allows users to track business expenses, mileage, and hours through a web dashboard and Telegram bot interface. The Service uses artificial intelligence to process receipts, categorize expenses, and generate reports.
3. Beta Service
ClaryBook is currently in beta. This means:
- The Service may contain bugs, errors, or inaccuracies
- Features may change, be added, or be removed without notice
- There may be occasional downtime or service interruptions
- AI-generated categorizations and data extraction may not always be accurate
You are responsible for verifying the accuracy of all data, reports, and tax documentation generated by the Service before relying on them for tax filing or other purposes.
4. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- The accuracy and legality of the data you input
- Ensuring your use complies with applicable laws and regulations
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to facilitate illegal activity
- Submit false, fraudulent, or misleading financial data
- Attempt to gain unauthorized access to the Service or other user accounts
- Reverse engineer, decompile, or attempt to extract the source code
- Use the Service to send spam, malware, or abusive content
- Overload, disrupt, or interfere with the Service infrastructure
- Resell, redistribute, or sublicense access to the Service without permission
- Use automated means (bots, scrapers) to access the Service beyond normal use
Violation of these terms may result in immediate suspension or termination of your account.
6. Financial and Tax Disclaimer
ClaryBook is a bookkeeping tool, not a tax advisor, accountant, or financial advisor. The Service:
- Does not provide tax, legal, or financial advice
- Does not guarantee the accuracy of AI-generated categorizations or calculations
- Does not replace professional accounting or tax preparation services
- Should not be relied upon as the sole basis for tax filing decisions
Always consult a qualified tax professional or CPA before filing taxes based on reports generated by the Service.
7. Intellectual Property
The Service, including its design, code, features, and branding, is the intellectual property of ClaryBook. You retain ownership of the data you submit to the Service.
By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service to you.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARYBOOK AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Errors or inaccuracies in AI-generated data, categorizations, or reports
- Tax penalties or liabilities resulting from reliance on the Service
- Service interruptions, downtime, or data loss
- Unauthorized access to your account or data
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless ClaryBook and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these terms, or infringement of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time from your account settings.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or legitimate business purposes.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
